Terms of Service

Effective date: October 13, 2026 · Last updated: October 16, 2026

1. Acceptance of these terms

These Terms of Service (the “Terms”) are an agreement between you and PlateWiz (“PlateWiz”, “we”, “us”). They govern your use of the PlateWiz mobile application and related backend services (together, the “Service”).

By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service. Our Privacy Policy, available at privacy.html, explains how we handle your information and forms part of your agreement with us once published.

2. The Service

PlateWiz is a nutrition and calorie-tracking app. It lets you:

We may add, change or remove features at any time.

3. Eligibility

You must be at least 16 years old to use the Service. If you are 16 or older but under the age of majority where you live, you confirm that a parent or legal guardian has reviewed and agrees to these Terms. By creating an account you confirm that you meet these requirements. If we learn that someone under 16 has an account, we may delete it.

For users under 18, the Service limits weight-loss plans to a gentle pace and calculates targets with a standard formula only.

The Service is not designed for, and you should not use it in place of, treatment for an eating disorder or any medical condition (see Not medical advice). You must be legally able to enter into this agreement and not be barred from using the Service under applicable law.

4. Your account

You create an account by signing in with your Apple or Google account. Authentication is handled by our identity provider, Clerk. We store the email address associated with your account and the profile information you provide in the app.

You are responsible for keeping your sign-in credentials secure and for all activity under your account. Provide accurate information, including your birthdate, height, weight and goal, because your calorie and macro targets depend on it. Tell us promptly at the address in Contact if you believe your account has been compromised. One person may not maintain accounts for the sole purpose of evading a suspension or limit.

5. Not medical advice

PlateWiz is an informational tool, not a medical service. It does not provide medical, dietetic or other professional advice, diagnosis or treatment, and using it does not create a professional relationship with you.

Calorie and macro targets are calculated from a general formula and the information you enter; they are estimates for healthy adults and may not suit your circumstances. As basic safeguards, the Service won’t set daily calorie targets below 1,200 kcal (women) or 1,500 kcal (men), won’t create a weight-loss plan if your weight is already below the healthy range for your height, and won’t accept a goal weight below that range. These safeguards are not a substitute for professional advice. Talk to a doctor or registered dietitian before starting or changing a diet, weight-management or exercise programme, particularly if you are pregnant or breastfeeding, are under 18, have or are recovering from an eating disorder, have diabetes, allergies, kidney, heart or other medical conditions, or take medication. Never ignore professional advice or delay seeking it because of something in the Service. If you feel unwell or are in crisis, stop using the Service and contact a healthcare professional or emergency services.

Nutrition values are not reliable enough to manage allergies, intolerances or medical dietary restrictions. Always check ingredient labels and ask the food’s preparer.

6. AI-generated output

Meal photos, text descriptions, corrections, coach messages and diet-plan preferences you submit are analysed by a third-party artificial-intelligence model (currently Google’s Gemini models) to produce the estimates, scores, tips, questions, coach replies, diet plans, targets and weekly summaries described above. By submitting content for analysis you instruct us to send it to that provider for that purpose.

7. Your content and license

“Your Content” means the meal photos, text descriptions, manual entries, weight and water logs, profile information and other material you submit to the Service. You keep ownership of Your Content.

You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, resize, display and reproduce Your Content, and to send it to the service providers described in Third-party services, solely to operate, secure, maintain and provide the Service to you (including generating AI analysis, statistics, summaries and notifications). This license lasts while Your Content is stored with us and ends when it is deleted, except for transient or backup copies that are removed in the ordinary course.

You promise that you have the right to submit Your Content and that doing so does not violate any law or anyone else’s rights. Your Content is private to your account; the Service does not include features for publicly sharing it with other users.

You can delete individual meals (which also deletes the associated photo), export your data as a CSV file, and delete your whole account at any time. See Termination and deletion.

8. Acceptable use

You agree not to:

Photos are limited to image files of up to 8 MB each. To protect the Service and keep it affordable, AI features have daily limits, which currently are: 15 AI meal logs (photo or text logs and “Fix with AI” corrections), 40 coach messages and 5 diet plans per day. Limits reset at midnight in your time zone, and a request that fails doesn’t count. Manual, barcode and re-logged meals are not limited. We may change these limits; where we do, we will apply them to the Service generally.

9. Fees

The Service is currently free to use, and the app does not contain subscriptions or in-app purchases. We may introduce paid features in the future. If we do, we will tell you before you are charged, and you will not be charged for anything without your agreement to the price and billing terms presented at the time. Your mobile data plan and carrier charges are your own responsibility.

10. Notifications

With your permission, the app sends push notifications such as meal reminders, streak reminders and weekly-summary alerts. Reminder times can be adjusted, and you can turn these notifications off in the app’s settings or in your device’s system settings.

11. Third-party services

The Service relies on third parties, and some of your information is processed by them in order to provide the Service. Their own terms and policies apply to their services. Providers we use include:

We do not control third-party services and are not responsible for their acts, omissions, availability or content. Details of what data is shared with them are set out in our Privacy Policy.

12. Our intellectual property

The Service, including the app, its design, text, graphics, trademarks, logos and software, is owned by us or our licensors and protected by intellectual-property laws. Subject to these Terms, we grant you a personal, limited, revocable, non-exclusive, non-transferable license to install and use the app on your devices for your own personal, non-commercial use. All rights not expressly granted are reserved.

If you send us feedback or suggestions, we may use them without restriction or compensation to you.

13. Termination and deletion

By you. You can stop using the Service at any time. To delete your account, use “Delete your account” in the app’s Profile screen. This deletes your sign-in account with our authentication provider straight away, then permanently deletes your meal photos from our image storage and your profile, targets, meals and meal items, corrections, weight and water logs, summaries and usage records from our database. That clean-up runs in the background and retries until it completes, normally within minutes. Deletion cannot be undone. You can export your data first using the in-app export. Some residual copies may remain for a limited time in backups or provider logs.

By us. We may suspend or terminate your access, with or without notice, if you breach these Terms, if we are required to by law, if your use creates risk or legal exposure for us or others, or if we discontinue the Service. If we terminate your account without cause, we will give you a reasonable opportunity to export your data where practicable.

Sections that by their nature should survive termination (including Your Content license for retained backups, Our intellectual property, Disclaimers, Limitation of liability, Indemnification and Governing law) will survive.

14. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted or error-free operation. We do not warrant that nutrition estimates, targets, scores or any other output are accurate, complete or suitable for you, or that the Service will meet your health or weight goals.

Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you. Nothing in these Terms excludes rights you have under mandatory consumer-protection law.

15. Limitation of liability

To the maximum extent permitted by law, PlateWiz and its owners, officers, employees, contractors and licensors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, data, goodwill or health outcomes, arising out of or related to your use of (or inability to use) the Service, even if advised of the possibility. Our total liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the 12 months before the claim, which is currently zero, and (b) [US$100].

Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, fraud, or willful misconduct.

16. Indemnification

To the extent permitted by law, you will defend and indemnify us against claims, losses and expenses (including reasonable legal fees) arising from Your Content, your breach of these Terms, or your violation of any law or third party’s rights.

17. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will give notice in the app or by email before they take effect where practicable, and update the “Last updated” date above. By continuing to use the Service after the changes take effect you accept the updated Terms. If you do not agree, stop using the Service and delete your account.

18. Governing law and disputes

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Service will be brought exclusively in the state or federal courts located in Florida, and you and we consent to their jurisdiction, except that either party may seek injunctive relief in any competent court.

If you are a consumer, you may also have the benefit of mandatory protections of the law of the place where you live. If any part of these Terms is unenforceable, the rest remains in effect. These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Service, and our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.
